Phoenix Martial Arts Participant Waiver

Participant Liability Waiver, Release & Photo Consent

Please read this agreement carefully before signing. By signing and submitting this form, I acknowledge that I have read, understand, and voluntarily agree to all of the terms contained in this Participant Liability Waiver, Release & Photo Consent.

1. Acknowledgment of Risk

I understand that participation in Phoenix Martial Arts classes, seminars, demonstrations, workshops, competitions, training sessions, and related activities involves inherent and other risks. These risks may include, without limitation, falls, collisions, physical contact with instructors or other participants, throws, takedowns, grappling, striking, joint movement, use of training equipment, muscle strains, sprains, fractures, bruises, cuts, concussions, other bodily injuries, and, in rare circumstances, serious injury, disability, or death.

I understand that risks may also arise from the actions or inactions of other participants, instructors, staff, volunteers, spectators, or other persons, as well as from facility conditions, equipment, transportation, weather, or other circumstances associated with an event or activity.

I understand that there may also be risks or hazards associated with the activity that are not presently known, foreseeable, or reasonably anticipated.

2. Voluntary Participation

I am voluntarily participating in the activity and understand the nature of the activities involved. I represent that I am physically and mentally capable of participating and will notify an instructor or event representative if I have an injury, medical limitation, or other condition that may affect my ability to participate safely.

I agree to participate within my own abilities and to follow all reasonable safety instructions, rules, and directions provided by Phoenix Martial Arts instructors, staff, or event representatives.

3. Assumption of Risk

I knowingly and voluntarily assume the risks associated with my participation in martial arts training and related activities, including risks that are inherent in the activity and risks that may arise from circumstances associated with the activity.

4. Release and Waiver

To the fullest extent permitted by applicable law, I release and discharge Phoenix Martial Arts, its instructors, owners, employees, contractors, volunteers, representatives, event organizers, affiliated organizations, and the owners or operators of facilities used for the activity (collectively, the "Released Parties") from claims, demands, actions, damages, liabilities, costs, or expenses arising out of or relating to my participation in the activity, including claims arising from personal injury, property damage, or other loss, except to the extent such release is prohibited by law.

I understand that this release is intended to be as broad and inclusive as permitted by applicable law. Nothing in this agreement is intended to release or waive any right or claim that cannot legally be released or waived.

5. Facility, Equipment, and Conduct

I agree to use training areas and equipment responsibly and only as instructed. I will follow applicable facility rules and will conduct myself in a manner that does not intentionally or recklessly endanger myself or others.

I agree to promptly notify an instructor or event representative if I observe an unsafe condition, damaged equipment, or another circumstance that I reasonably believe may present a safety concern.

I understand that Phoenix Martial Arts or an event instructor may modify, restrict, or discontinue my participation if they reasonably believe that my conduct, physical condition, or participation presents a safety concern.

6. Personal Property

I understand that I am responsible for my personal belongings and agree that the Released Parties are not responsible for loss, theft, or damage to personal property brought to or left at an event or facility, except to the extent otherwise required by law.

7. Medical Treatment

In the event of an injury or medical emergency, I authorize event staff or emergency personnel to obtain reasonable emergency medical assistance on my behalf when deemed necessary. I understand that I am responsible for my own medical expenses and that Phoenix Martial Arts does not provide medical or health insurance coverage for participants.

8. Photography, Video, and Other Media Release

I understand that photographs, video recordings, audio recordings, and other media may be taken during Phoenix Martial Arts classes, seminars, demonstrations, events, or related activities.

By signing this agreement, I grant Phoenix Martial Arts permission to photograph, record, and otherwise capture my image, likeness, voice, or participation during the activity and to use such photographs, recordings, or other media for legitimate promotional, educational, informational, advertising, website, social media, or other organizational purposes.

I understand that such media may be edited, reproduced, published, displayed, distributed, or otherwise used in print or digital formats, including on Phoenix Martial Arts websites and social media accounts, without further notice or compensation to me.

I understand that I will not have a right to inspect or approve the finished photographs, recordings, or other media before they are used.

I release Phoenix Martial Arts and its authorized representatives from claims arising from the authorized use of my image, likeness, voice, or recordings as described above, except to the extent prohibited by applicable law.

9. No Guarantee of Safety

I understand that instructors and event organizers will make reasonable efforts to conduct activities in a safe and responsible manner, but that no safety procedures can eliminate all risks inherent in martial arts or physical activity. I understand that participation carries risks that cannot be completely eliminated.

10. Minor Participants

If the participant is under 18 years of age, I represent that I am the participant's parent or legal guardian and that I have the legal authority to provide consent for the participant's participation in Phoenix Martial Arts activities.

As the parent or legal guardian of the minor participant, I have read and understand this agreement, including the acknowledgment of risk, assumption of risk, release and waiver, medical treatment provisions, and photography/video/media release. I voluntarily consent to the minor's participation in Phoenix Martial Arts activities and agree to the terms of this agreement on the minor participant's behalf to the extent permitted by applicable law.

I understand that the minor participant is expected to follow applicable safety rules, instructor directions, and facility rules, and that Phoenix Martial Arts may modify, restrict, or discontinue the minor participant's participation when reasonably necessary for safety.

11. Agreement and Acknowledgment

I confirm that I have carefully read this entire agreement before signing. I understand that it contains an assumption of risk and a release of liability. I have had the opportunity to ask questions and seek clarification regarding any provision that I do not understand.

By signing below, I affirm that I understand and voluntarily agree to the terms of this entire agreement, including the assumption of risk, release of liability, personal property provisions, medical treatment provisions, and photography/video/media release. If signing as the parent or legal guardian of a minor participant, I affirm that I have the authority to provide such consent. I understand that my electronic signature constitutes my acknowledgment and agreement to these terms.

12. Electronic Signature

I understand that submitting this form electronically and providing my signature represents my intent to sign this agreement electronically and to be bound by its terms to the same extent as a handwritten signature, to the extent permitted by applicable law.

I have read, understood, and voluntarily agree to the Phoenix Martial Arts Participant Liability Waiver, Release & Photo Consent above.
